This Clarification Text has been prepared by Ocean Fish, acting as the data controller, pursuant to Article 10 of the Turkish Law No. 6698 on the Protection of Personal Data ("KVKK") and the related Communiqué on the Principles to be Followed in Fulfilling the Obligation to Inform, in order to explain the principles governing the processing of personal data of our customers, suppliers, visitors and users of our website.
Data Controller
Your personal data is processed by Oceanfish Su Ürünleri Gıda Pazarlama Sanayi ve Ticaret Ltd. Şti. ("Ocean Fish" or the "Company"), acting as data controller, within the scope described below.

Personal Data Processed
Depending on the nature of your relationship with our Company, your personal data falling within the following categories may be processed:
- Identity data: name, surname, title (if any) and the organisation you represent.
- Contact data: telephone number, e-mail address, postal address, fax number.
- Customer/supplier transaction data: order, delivery, invoice, payment and current-account records.
- Financial data: bank account details and payment information.
- Transaction security data: IP address, cookie records and website access/transaction logs.
- Marketing data: records relating to your requests and complaints, surveys and your commercial electronic message preferences.
Purposes of Processing
Your personal data is processed based on the conditions set out in Articles 5 and 6 of the KVKK, primarily in connection with our activities of supplying and marketing sea and lake seafood and aquaculture products, for the following purposes:
- Conducting sales processes for goods and services and carrying out order and delivery operations.
- Maintaining an uninterrupted cold chain and ensuring a traceable "from sea to table" flow.
- Managing customer and supplier relationships and evaluating requests and complaints.
- Carrying out invoicing, collection and accounting-finance processes.
- Fulfilling obligations arising from ISO, HACCP, Helal, BRC and IFS standards and food legislation.
- Fulfilling legal obligations towards competent authorities and institutions.
- Operating our website and ensuring its security and continuity.
- Carrying out promotional and marketing activities where your explicit consent is obtained.
Legal Grounds
Your personal data is processed on the basis of the following legal grounds set out in Article 5 of the KVKK:
- Processing being directly related to the conclusion or performance of a contract.
- Processing being mandatory for our Company to fulfil its legal obligations.
- Processing being mandatory for the establishment, exercise or protection of a right.
- Processing being mandatory for the legitimate interests of our Company, provided that it does not harm your fundamental rights and freedoms.
- Processing being expressly stipulated by law.
- Obtaining your explicit consent where none of the above conditions apply.
Transfer
Your personal data may be transferred, limited to the achievement of the purposes set out above and in accordance with the conditions provided in Articles 8 and 9 of the KVKK, to:
- Competent public authorities and institutions for the fulfilment of legal obligations.
- Our business partners and suppliers providing logistics, storage, transport and cold-chain services.
- Parties from whom we receive financial advisory, audit, IT and legal consultancy services.
- Banks and payment service providers.
Your personal data is not transferred abroad, except where your explicit consent exists or the other conditions stipulated under the KVKK are met.
Retention Period
Your personal data is retained for the periods required by the processing purposes and, in any case, limited to the statutes of limitation and retention periods set out in the relevant legislation (in particular obligations arising from commercial, tax and food legislation). Upon expiry of these periods, your personal data is deleted, destroyed or anonymised.
Your rights under Article 11 of the KVKK
Pursuant to Article 11 of the KVKK, you may exercise the following rights by applying to the data controller:
- To learn whether your personal data is being processed.
- To request information if your personal data has been processed.
- To learn the purpose of processing and whether the data is used in accordance with that purpose.
- To know the third parties to whom your personal data is transferred domestically or abroad.
- To request rectification of your personal data if it has been processed incompletely or inaccurately.
- To request deletion or destruction of your personal data within the framework of the conditions set out in Article 7 of the KVKK.
- To request that rectification, deletion and destruction operations be notified to third parties to whom the data has been transferred.
- To object to a result arising against you through the analysis of your processed data exclusively by automated systems.
- To claim compensation for damages incurred due to the unlawful processing of your personal data.
Application method
You may submit your requests regarding the rights listed above to our Company together with information and documents verifying your identity. You may submit your applications by wet-signed written petition delivered in person or by post to our address indicated above, or by e-mail to info@oceanfish.com.tr. Your request will be concluded free of charge as soon as possible and within thirty days at the latest, depending on its nature; however, if the process requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board may be charged.
